Petty Theft: Petty theft (Penal Code Section 484) is the most common theft offense and although relatively minor can have long lasting effects in terms of future employment, licensing, and other pursuits. Quite often, a properly handled petty theft case can be reduced to a lesser non theft related charge such as trespassing or a noncriminal infraction. In other situations, a civil compromise can be reached leading to a dismissal.
Shoplifting: Shoplifting is generally charged under Section 484 above. However, the state may, and often does, charge commercial or 2nd degree burglary (Penal Code Section 459) which is a wobbler for the same crime. California Penal Code 459 defines burglary as entering a structure or other specified enclosure with the intent to commit a crime once inside. Therefore, the prosecution will file these charges on the theory that the defendant decided to commit theft before entering the store.
